The rules surrounding travel pay vary based on several factors. Whether workers are traveling on assignment, driving company vehicles or their own cars are just a few items that must be considered when tackling this confusing topic. To complicate matters, commuting time, waiting time and on-call time are also governed by FLSA and usually intersect with travel time.

Many employers do not understand how or when to compensate an employee for time spent traveling to destinations other than a regular work-site. Sending employees to conferences and other work-sites using commercial travel and personal vehicles adds to the mix of questions that often arise and cause FLSA errors which can be very expensive come audit time.

Employee travel errors can result in a well-meaning employer facing an FLSA lawsuit stemming from little or no compensation for time spent traveling for work. Employers must also keep in mind IRS rules on reimbursing travel expenses, including changes made by the Tax Cuts and Jobs Act of 2017.
