Fundamentals of Florida Residential Evictions
Are you up-to-date on the latest issues impacting Florida residential evictions? The Florida Landlord Tenant Statute determines the rights and duties of both the landlord and the tenant, and provides specific procedures that must be followed to terminate the tenancy and evict the tenant. If you do not know these requirements, you may not only lose the eviction suit in court, but you may end up paying the tenant’s attorney’s fees. Few residential evictions make it to an appellate court, much less the supreme court, so case law is scarce. And yet County Courts throughout Florida hear thousands of evictions every month. These County Courts have evolved their own interpretation of the law, sometimes arriving at surprising and unexpected results. These can only be learned from years of practicing in these courts and reading what County and Circuit Court opinions are published. You will not find these decisions on Lexis or Westlaw. You will gain the benefit of my twenty years of practicing landlord tenant law and authoring over two hundred articles on the subject.
